What is a trade promotion?

A trade promotion is a competition used to promote goods or services supplied by a business. The three key elements of a trade promotion are free entry, promoting goods or services and being a registered business.

Trade promotions are a great way to promote your business and increase traffic to your website or social media channels.

There are two types of promotional competitions in Australia – a game of skill and a game of chance.

What We Offer

Do I need a permit to run a trade promotion?

Our team of commercial lawyers can confirm the exact requirements for you to run a trade promotion in your state or territory. Each state and territory in Australia has its own laws in relation to trade promotions.

For example, NSW law requires businesses wishing to run a trade promotion to apply for and obtain a trade promotion lottery permit.

Normally the state regulator will require you to submit the competition terms and conditions before they will issue a permit.

Frequently Asked Questions

Yes they are. You do not require a permit to conduct a trade promotion which is a game of skill (e.g. “describe in 50 words or less why you should win this prize”).

For a game of chance (e.g. a lottery), you do require a permit in certain states and territories. We can make sure your trade promotion is legally compliant and also draw up terms and conditions for the competition.
